4. Marriage and employment

Candace Wilson and Enrique Partune met as co-workers and eventually married, but the policy at the water districts forces one of them to quit, or would terminate them both. They have been suspended for fifteen days without pay, and are expected to decide which one would quit. The couple however appealed the decision and they base this on discrimination. Their primary argument is that at least one same-sex married couple is working in the district and that two other unmarried heterosexual couples are also working in the district. Candace and Enrique as such feel discriminated against because they are married.

But the true discrimination does not come from the fact that the married couple is discriminated against the other same sex or unmarried couples, but is pegged to the fact that the very policy forbidding spouses to work within the district is flawed.

Within today's working environment, such a law is abusive and unjustified. It is as such immoral and unethical to prevent spouses from working in the same district. It could be argued that conflicts of interest could arise, but the agency should be responsible and professional enough to prevent these conflicts, to identify them and to resolve them. In eventuality, it would be possible to ensure that the spouses do not work on the same or on complementary projects and that whenever conflicts of interest arise, one of the spouses would be moved to a different project. Overall, the ruling should be in favor of the couple, but not necessary on grounds of discrimination between married and unmarried couples, but based on the legitimacy of the policy at the water district......
