As anyone who is arrested by law enforcement must be made aware of their basic civil rights. At which point, you have the option of determining if: you would like to talk to law enforcement alone or with your lawyer present during all questioning. You would then be booked and transferred to the jail, awaiting your preliminary hearing before the courts. ("Rights of the Accused," 2008)

Once this begins, is the point that a suspect can challenge their detention and question the fact that they may be innocent. Where, the judge will listen to arguments from both sides, to determine if there were any possible abuses that are: occurring and the preponderance of evidence against them. If there is sufficient evidence, they will set a trial date and listen to bail requests from the defense. Depending upon the severity of the crime and the possibility that the defendant could be a flight risk, the judge will decide if the accused could be released on bail or if they must stay in prison until their trial.
