What is European Union's Social Charter

The Social Charter of Europe is a treaty by the European Council which guarantees fundamental economic and social freedoms. It is an equivalent of the European Human Rights Convention, which deals with political and civil freedoms. It guards a wide range of day-to-day freedoms of human beings that have to do with education, housing, social welfare and protection, employment and health. The Charter is particularly focused on protecting minority people like children, the disabled, the aged as well as migrants. The Charter emphasizes on the granting of the freedoms stated above, free from discrimination. The Charter is the only Pan-European legal instrument that has the power to give such complete and extensive social rights protection. It is also used as reference in the laws of the EU. In fact, the Fundamental Rights Charter of the EU came up with many social rights regulations based on what the Charter indicates. For this reason, the Charter has been recognized as the European Social Constitution. It is also a very important part of the architecture of European human freedoms (Council of Europe, n.d.).

Why is it important for U.S. firms dealing with European unions to be aware of this?

The Charter's treaty system incorporates international policies on social freedoms and a method of overseeing the execution of those regulations in the respective States.
The system:

• Protects a wide range of the day-to-day human freedoms that are linked with social protection, health care, housing, working and employment conditions as well as education;

• Is particularly concerned with guarding minority persons like the aged, disabled, migrants as well as children. It also ensures that all the rights stated above are guarded, free from discrimination;

• Draws its regulations from the doctrine of interrelation, indivisibility, interdependence and universality of human freedoms, which was declared during the 1993 Vienna Declaration of the UN, which asserts that human and social freedoms are equal to political and civil freedoms;

• Is complementary to the Pan-European safeguards stated in the Human Rights Convention of the EU, which focus particularly of political and civil freedoms;

• Is the central factor in the legislative goals of the European Council: human freedoms, democracy and decree of law, which are unachievable if social rights are not respected (Council of Europe, n.d.).
